Sweepstakes Casinos in Massachusetts Spared for 2026
Sweepstakes casinos got a rare win in the 2026 legislative session, as the Massachusetts House’s Joint Committee on Economic Development and Emerging Technologies voted 11-0 to send a bill that would have targeted sweepstakes casinos in Massachusetts back for further study.
House Bill 4431 also would have legalized casino gambling in Massachusetts, which would have matched the Commonwealth to neighbors Connecticut and Rhode Island. However, the decision to send the bill back for study pauses both efforts until at least 2027.
Most of the attention HB 4431 drew focused on the efforts to bring iGaming to the Commonwealth. However, the bill featured tough penalties for sweepstakes casino operators. It would have made sweepstakes casinos in Massachusetts illegal, with a $100,000 fine for a violation.
Those provisions now won’t go into effect at any point in 2026. Rep. David Muradian Jr. (R-Grafton) has said that he expects the pause period to serve as a chance to further economic growth in the Bay State, while simultaneously adding protections for consumers. That suggests Muradian will attempt to try again in 2027, but Massachusetts politics suggests a tough fight ahead.
What Will 2027 Efforts Regarding Sweepstakes Casinos in Massachusetts Look Like?
Massachusetts’ legislature operates on a two-year cycle, with most business conducted in odd years. For a bill to reach the floor of the Massachusetts General Court, it must advance through its committee, which either gives it a favorable report, adverse report or a study order.
The study order was applied to HB 4431. In practice, that means the bill doesn’t have enough votes to pass, and most bills that receive the study order are quietly shelved. That’s one reason why Muradian’s bill has a difficult fight ahead. While it’s not as difficult to overcome as an adverse report, which stops the bill there, it’s hard to get committee members to change their minds.
HB 4431 also would need strong support from Muradian’s opposite party. Muradian is one of just 30 Republicans in the entire Massachusetts General Court, as Democrats control 84% of the state House and 87% of the state Senate. Gov. Maura Healey is also a Democrat, meaning Muradian’s bill has no chance to pass without Democratic backing.
What Does This Mean for Online Gambling in Massachusetts?
First, social casinos will remain legal for 2026. While the Massachusetts gaming commission has officially discouraged residents from using these sites, the tabling of HB 4431 means that sweepstakes casinos can still operate legally for at least another year.
Those wishing to gamble online with real money still have both sports betting and the Massachusetts Lottery, the latter of which comes online this year. The Commonwealth is also home to three brick-and-mortar casinos.
What’s the Future Look Like?
What Muradian or another representative does next will decide where Massachusetts’ priorities lie. Muradian could opt to split his bill into two separate issues, which would greatly increase the chances of sweepstakes casinos being banned. As written, HB 4431 was an all-or-nothing proposal, and with many legislators hesitant to support iGaming, that contributed to Massachusetts giving sweepstakes casinos a reprieve.
The other option is to try again with a similar bill that keeps the issues coupled. That appears to be the favored option, as writing new legislation is a cumbersome process. Whether Muradian cares more about bringing iGaming to Massachusetts or banning sweepstakes casinos will have a major impact on bettors in the Commonwealth, one way or another.
